Terms of Service

Welcome to EnerStudio.io ("EnerStudio," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the EnerStudio website, application, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

EnerStudio is an AI-powered platform that lets you generate videos — including cinematic clips, avatar and spokesperson videos, product ads, and other formats — from text prompts and other inputs you provide. Features, formats, and limits may change over time as we improve the Service.

2. Eligibility & accounts

You must be at least 18 years old to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Provide accurate information and keep it up to date.

3. Free trial, subscriptions & billing

Paid plans are billed through our payment processor (Stripe) on a recurring basis according to the plan you choose. Current pricing is shown on our pricing page. Free trials, where offered, convert to a paid subscription unless cancelled before the trial ends. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.

4. Acceptable use

You agree not to use the Service to create, upload, or distribute content that:

• is unlawful, infringing, defamatory, hateful, harassing, or fraudulent;
• depicts a real, identifiable person (including their face, voice, or likeness) without that person's permission, or impersonates any individual or organization;
• sexualizes minors or is otherwise harmful to children;
• violates the intellectual-property, privacy, or other rights of any third party; or
• attempts to disrupt, reverse-engineer, or gain unauthorized access to the Service or its underlying systems.

You are responsible for the prompts you submit and the content you generate, and for ensuring you have the rights to use any material you upload.

5. Your content and ownership

You retain ownership of the original inputs you provide. Subject to your compliance with these Terms and the terms of the underlying AI providers, you may use the videos you generate for your personal and commercial purposes. You grant EnerStudio a limited license to process, store, and transmit your inputs and outputs solely to operate and improve the Service. Free-tier outputs may include an EnerStudio watermark.

6. Third-party AI and services

The Service relies on third-party providers for AI generation, hosting, voice, payments, and analytics. Your use of the Service may also be subject to those providers' terms. We are not responsible for the availability or output of third-party systems.

7. Intellectual property

The Service, including its software, design, branding, and content (excluding your inputs and outputs), is owned by EnerStudio and protected by intellectual-property laws. You may not copy, modify, or create derivative works of the Service except as expressly permitted.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. AI-generated output can be inaccurate, unexpected, or unsuitable for a given purpose, and you are responsible for reviewing it before use. We do not guarantee that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, EnerStudio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

10. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could cause harm or liability. Upon termination, your right to use the Service ends.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
